1. Scope

This website is operated by Yaya Capital Limited. By using it you accept these terms. Where these terms conflict with a signed loan agreement, the loan agreement prevails in respect of that loan.

2. Information is not an offer

Product descriptions, eligibility checks and calculator results are indicative and for information only. They do not constitute an offer of credit, a pre-approval, or a commitment to lend. Any credit is subject to application, verification, assessment and approval.

3. Accuracy of the information you give us

You must provide information and documents that are true, current and complete. Providing false or misleading information may result in refusal of an application, withdrawal of an offer, recall of a facility, or referral to the competent authorities.

4. Your account and security

• Keep your login credentials confidential and do not share them.
• Notify us immediately of any suspected unauthorised access.
• You are responsible for activity carried out under your credentials.
• We may suspend access where we reasonably suspect misuse or fraud.

5. Acceptable use

• Do not attempt to access data or functions you are not authorised to use.
• Do not probe, scan, disrupt or overload the platform.
• Do not upload malicious files or unlawful content.
• Do not use the platform for money laundering, fraud or any unlawful purpose.

6. Availability

We aim to keep the platform available but do not guarantee uninterrupted service. Maintenance, connectivity conditions or events beyond our control may cause interruptions.

7. Intellectual property

The Yaya Capital name, logo, and the content of this site are our property or licensed to us, and may not be copied or used commercially without written permission.

8. Limitation

To the extent permitted by law, we are not liable for indirect or consequential loss arising from use of this website. Nothing in these terms excludes liability that cannot lawfully be excluded.

9. Governing law

These terms are governed by the laws of South Sudan, and disputes fall within the jurisdiction of its courts. Times and dates are expressed in Africa/Juba.

10. Changes

We may amend these terms. Continued use after publication of an amended version constitutes acceptance.
